Town of Kindersley Zoning Bylaw
(A Bylaw to regulate Zoning and Development)

Public Notice is hereby given that the Council of the Town of Kindersley, pursuant to Section 207 of The Planning and Development Act, 2007, intends to consider Bylaw 08-16 to amend Bylaw 04-14, known as the Zoning Bylaw.

INTENT

The proposed Bylaw will amend the Zoning Bylaw 04-14 as follows:

  • SECTION 2 – INTERPRETATION is amended by adding the following new definitions: “Community Events”, “Curb Cutting”, “Driveway”, “Driveway, Apron”, “Garage/Yard Sale”, “Neutral Colour”, “Permeable Paving Materials”, “Signboard”, “Sign, Traffic”, “Street Furniture”.
  • SECTION 2 – INTERPRETATION is amended by deleting “Shipping Container” in its entirety and replacing it.
  • SECTION 3.5 – DEVELOPMENT PERMIT APPLICATION FEES is amended by deleting subsection 3.5.1 in its entirety and replacing it.
  • SECTION 3.5 – DEVELOPMENT PERMIT APPLICATION FEES is amended by deleting subsection 3.5.1 in its entirety and replacing it.
  • SECTION 3.11 – FEES is amended by deleting clause (1) in its entirety and replacing it.
  • SECTION 4.5 – VISIBILITY CLEARANCE AT INTERSECTIONS is amended by deleting in its entirety and replacing it.
  • SECTION 4.7 – FENCES is amended by adding a new subsection after subsection 4.7.4.
  • SUBSECTION 4.8.3 – HEIGHT OF ACCESSORY BUILDINGS is amended by deleting in its entirety and replacing it with a new section.
  • SUBSECTION 4.8.5 – LOCATION AND SIZE OF ACCESSORY BUILDINGS is amended by deleting clause (1)(a) in its entirety and replacing it.
  • SUBSECTION 4.8.5 – LOCATION AND SIZE OF ACCESSORY BUILDINGS is amended by deleting clause (1)(e) in its entirety and replacing it.
  • SUBSECTION 4.8.5 – LOCATION AND SIZE OF ACCESSORY BUILDINGS is amended by deleting clause (1)(h) in its entirety.
  • SUBSECTION 4.8.5 – LOCATION AND SIZE OF ACCESSORY BUILDINGS is amended by deleting the existing table and replacing it.
  • SUBSECTION 4.8.5 – LOCATION AND SIZE OF ACCESSORY BUILDINGS is amended by deleting Notes to Summary Table for Detached Accessory Buildings in its entirety and replacing it.
  • SUBSECTION 4.8.5 – LOCATION AND SIZE OF ACCESSORY BUILDINGS is amended by deleting clauses (2)(a) and (2)(b) in its entirety and replacing it.
  • SUBSECTION 4.8.8 – SHIPPING CONTAINERS is amended by deleting in its entirety and replacing it with a new subsection.
  • SUBSECTION 4.9.4 – REQUIRED OFF STREET PARKING AND LOADING IN ALL DISTRICTS is amended by adding two new clauses after clause (3).
  • SECTION 4.9 – OFF-STREET PARKING AND LOADING is amended by adding a new subsection after subsection 4.9.4.
  • SUBSECTION 4.10.1 – GENERAL is amended by adding a new clause after clause (5).
  • SUBSECTION 4.10.3 – LICENSING OF PORTABLE SIGNS is amended by deleting clause (1) in its entirety and replacing it.
  • SUBSECTION 4.10.3 – LICENSING OF PORTABLE SIGNS is amended by adding a new clause after clause (3).
  • SECTION 4.22 – GARAGE AND YARD SALES is amended by deleting in its entirety and adding a new subsection after subsection 4.10.7.
  • SECTION 4.28 – SCREENING is amended by deleting in its entirety.
  • Table 6-8: C1 – DOWNTOWN COMMERCIAL DISTRICT DEVELOPMENT STANDARDS is amended by deleting Discretionary Use: (1) Single detached dwellings and development standards and replacing it.
  • SECTION C1 – DOWNTOWN COMMERCIAL DISTRICT is amended by deleting Notes: Special limitations and standards regarding Table 6-8 and the C1 district and replacing it.
  • Bylaw 7-08, A Bylaw to Control and Regulate the Placement of Garage/Yard and Community Events Sign, and all amendments thereto, are hereby repealed.

AFFECTED LAND

The affected lands by the proposed Bylaw Amendment are all the lands within the Town of Kindersley corporate limits.

REASON

To clarify regulations and correct errors or omissions in the Zoning Bylaw 04-14.

PUBLIC INSPECTION

The proposed Bylaw may be inspected by any interested person(s) at the Town Administration Office, 106 – 5th Avenue East, between the hours of 8:30am and 4:30pm, Monday to Friday, except statutory holidays. Copies of the Bylaw and this Notice may be obtained at the Town Administration Office for a fee of one dollar ($1.00).

PUBLIC HEARING

Council will hold a public hearing on Monday, September 12, 2016 at 7:15 pm in the Council Chambers of the Town Administration Office to hear any person or group that wants to comment on the proposed Bylaw. Council will also consider written comments received at the hearing (or delivered to the undersigned at the municipal office before the hearing).
