Council welcomed two delegations to speak about a future swimming pool – Pool Fundraising Committee member Jamie Henry, who discussed her group’s commitment to continue fundraising and addressed some concerns with the lack of a specific concept; and Leaf Your Legacy Committee member Joanne Kosolofski who provided a review of the five-year campaign and also committed to future fundraising support if requested.

Council directed Administration to prepare a Request for Expressions of Interest (REOI) for an Aquatic Centre to be ready for preliminary review by Council at the January 9, 2017 Regular Meeting.

Members of the Kindersley Youth Committee also spoke to Council about their projects over the past year and the ways in which they have learned from the program. In accordance with the Youth Committee’s request, Council agreed to transfer any remaining balance of 2016 Youth Committee funds to the Fire Hall Reserve as a donation.

The Mayor and Chief Administrative Officer (CAO) were directed to execute the Letter of Acceptance from TD Commercial Banking to engage banking services for the Town of Kindersley, effective December 1, 2016 until November 30, 2021.

Administration was authorized to transfer the remaining 2016 Main Street Traffic Signal Project funds in the amount of $188,115.88 to the Machinery and Equipment Reserve so that replacement of the traffic signals can be completed in 2017.

Council agreed to amend the Backwash Water Program agreement currently in place with Holland’s Hot Oiling Ltd. to continue the rate of $1 per meter of water sold until full construction costs of the backwash reservoir are realized by Holland’s, or for 12 months from the passing of the resolution, whichever is sooner. This was a request of Holland’s earlier in 2016 to compensate for reduced demand.

The Canadian National Railway (CNR) Company’s application for proposed subdivision of 4.42 acres of land at the southwest end of Railway Avenue was supported by Council on the condition that a Servicing Agreement be entered with the Town and the Applicant pays a monetary settlement of $6,630, which represents five percent of the fair market value of the land, as required by Municipal Reserve Dedication, pursuant to Section 187 of the Planning and Development Act.

Related to the CNR application for subdivision, Council gave first reading to Bylaw 02-17, which amends the Zoning Bylaw by adding oilfield supply and service establishment as a discretionary use in the RW-Railway Industrial District.

Council directed Administration to waive the non-prime time ice fees for the Iron Horse Kindersley Klippers for the 2016-17 season only, and that a rate of $900 per regular season game be assessed to the team.

During a Special Meeting of Council held on December 6, 2016 to discuss urgent legal matters, the Council of the Town of Kindersley resolved to enter into a settlement agreement with 101217778 Saskatchewan Ltd. (778) on land related to the Rosedale Phase 7, Stages 2 & 3 residential housing development for which the developer failed to meet its obligations to develop as set out in the Option to Purchase Agreements dated September 27, 2012.

The resolution directs the Mayor and Chief Administrative Officer (CAO) to comply with the terms of settlement requested. These terms specify that the Town shall pay 778 the original purchase price of the land in the amount of $145,015.43 and that, in turn, title to the lands (Plan G 202 Extension 6, Surface Parcel #164303681) will be transferred back to the Town, free and clear of all encumbrances.

The settlement terms and conditions also outline that both parties shall further discontinue all legal action related to this claim on a without-costs basis.
